CHEYENNE, Wyo. - A federal judge has denied a request from Wyoming's lone death row inmate to force the state to turn over documents as part of his federal appeal.
Lawyers for inmate Dale Eaton had asked Judge Alan B. Johnson to order the state to produce documents Eaton's lawyers say would show that both the original prosecutor and defense lawyer mishandled his trial.
Johnson denied the request last week, saying the Eaton's lawyers can request documents after they file their main legal brief next month.
The 56-year-old Eaton was sentenced to death in the 1988 rape and murder of 18-year-old Lisa Marie Kimmell, of Billings, Mont.
Wyoming Attorney General Bruce Salzburg declined comment Tuesday on Johnson's ruling. An attempt to reach Eaton's lawyer wasn't successful.
